Terms of Service

1. Acceptance of Terms

By accessing or using the Justeach platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organisation (such as a coaching center or tuition institute), you represent that you have the authority to bind that organisation to these Terms.

If you do not agree to these Terms, you may not access or use the Service.

2. Description of Service

Justeach provides a cloud-based tuition and coaching center management platform that includes student management, attendance tracking, fee collection, batch scheduling, parent communication, and related tools. The Service is offered via web and mobile applications on a subscription basis.

3. Account Terms

• You must provide accurate and complete information when creating an account.
• You are responsible for maintaining the security of your account credentials. Justeach is not liable for any loss or damage arising from your failure to safeguard your login information.
• You must be at least 18 years of age to create an account and use the Service.
• One person or organisation may not maintain more than one free account.
• You are responsible for all activity that occurs under your account.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws or regulations.
• Upload or transmit malicious code, viruses, or any other harmful technology.
• Attempt to gain unauthorised access to the Service, other user accounts, or our systems.
• Use the Service to send unsolicited bulk messages or spam.
• Reverse-engineer, decompile, or disassemble any part of the Service.
• Resell, sublicense, or redistribute the Service without our prior written consent.
• Store or process data that you do not have the right to collect or use.

5. Payment Terms

• Paid subscription plans are billed in advance on a monthly or annual basis, depending on the plan selected.
• All fees are quoted in Indian Rupees (INR) and are inclusive of applicable taxes unless stated otherwise.
• Payments are processed securely through our payment gateway partner, Cashfree Payments.
• Failure to pay within the due date may result in suspension or termination of your account.
• We reserve the right to change our pricing with 30 days' advance notice. Existing subscribers will be notified before any price change applies to their account.

6. Subscription and Renewal

Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. You can cancel your subscription at any time from your account settings. Upon cancellation, you will retain access to the Service until the end of the current billing period.

7. Cancellation and Termination

• You may cancel your account at any time. Cancellation takes effect at the end of your current billing period.
• Upon cancellation, your data will be retained for 30 days, after which it will be permanently deleted. You may request a data export before cancellation.
• We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or remain inactive for an extended period, with reasonable notice where possible.

8. Data Ownership

You retain full ownership of all data you enter into the platform, including student records, attendance data, fee records, and communication content. Justeach does not claim ownership over your data.

We are granted a limited licence to process your data solely for the purpose of providing the Service. You can export or delete your data at any time.

9. Intellectual Property

The Justeach platform, including its design, code, branding, logos, and documentation, is the intellectual property of Justeach. You may not copy, modify, or distribute any part of the Service without our prior written permission.

10. Service Availability

We strive to maintain 99.9% uptime but do not guarantee uninterrupted access to the Service. Scheduled maintenance will be communicated in advance. We are not liable for downtime caused by circumstances beyond our reasonable control, including internet service disruptions, natural disasters, or third-party service outages.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Justeach and its affiliates, officers, employees, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of or inability to use the Service.

Our total liability for any claim arising from the Service shall not exceed the amount you paid to us in the twelve months preceding the claim.

12. Indemnification

You agree to indemnify and hold Justeach harmless from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

13. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of India. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts located in New Delhi, India.

14. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated with at least 30 days' notice via the platform or email. Your continued use of the Service after the effective date of changes constitutes acceptance of the updated Terms.
